Planning obligations and Section 106

Section 106 (s106) agreements are also known as Planning Obligations and are needed for some planning applications under Section 106 of the Town and Country Planning Act 1990 (amended by Section 12 of the Planning and Compensation Act 1991).

A S106 is a legally binding agreement between:

  • the council
  • the developer and
  • any others with an interest in the site to be developed.

This may include Slough Borough Council and the landowner.

The agreement is to:

  • regulate the future development of the land
  • compensate the local community for any impact caused by a development, for example if open space is lost
  • help shape the new development for example to make sure a certain number of houses are affordable homes.

Agreements can often include:

  • financial contributions
  • non-financial contributions, such as providing land for public open space, affordable housing or creating environmental monitoring schemes.

  • written confirmation that the Conditions on a Planning Approval have all been met or the Section 106 Obligations have been discharged

Please note this is not the form to use to apply to discharge Planning conditions which can be found on the Planning Portal .

Charges

The charge for this service is calculated based on the number of S106 agreements or planning applications within the enquiry, rather than a flat fee for each enquiry. These charges are calculated at the following rates:

  • Section 106 agreement - £175 for each S106 agreement listed in the enquiry.
  • Planning permission - £116 for each planning application listed in the enquiry.
